POINTE COUPEE PARISH SCHOOL BOARD

SPECIAL MEETING

 

Tuesday, November 25, 2008

 

 

The Pointe Coupee Parish School Board met in a special session on Tuesday, November 25, 2008, at the School Board Office, 337 Napoleon Street New Roads, Louisiana.  Mr. James M. Cline, President, called the meeting to order at 5:30 p.m.

 

Board members present were Messrs. Frank Aguillard, Chad Aguillard, Brandon Bergeron, James M. Cline, Kevin Hotard, Thomas Nelson and Mrs. Debbie Collins.

 

Frank R. Aguillard led the Pledge of Allegiance to the Flag of the United States of America.

 

Mr. Thomas Nelson offered the invocation.

School Board Vacancy Declared and Successor Appointed.  The Secretary of State's Office provided a copy of Mr. Joseph Major Thibaut, Jr.'s letter of resignation as a member of Pointe Coupee Parish School Board, District F, effective November 21, 2008.

 

President Cline stated that at the November 20, 2008 School Board meeting, Mr. Major Thibaut, Jr. had requested that the Board consider appointing his father, Mr. Joseph "Jody" Thibaut, Sr. to temporarily fill the vacancy until a special election is held.  Mr. Major Thibaut mentioned that his father is not interested in running for the office whenever there is a special election.  Mr. Cline reminded everyone that any School Board member can make a recommendation to appoint a person to fill the vacancy in District F providing that the person meets the qualifications of the office.  President Cline mentioned the requirement of public officials to file annual financial disclosure statements in accordance with HB 1.

 

On a motion by Mr. Frank Aguillard, seconded by Mr. Kevin Hotard, a School Board vacancy was declared for District F.

 

Mr. Thomas Nelson stated that due to the fact that Mr. Joseph "Jody" Major Thibaut, Sr. would like to serve as a temporary successor and does not wish to be a candidate in the special election, that he would like to make a motion to appoint him as a member of the Pointe Coupee Parish School Board, District F.  Mrs. Debbie Collins seconded the motion. 

 

Mr. Frank Aguillard made a motion to close the nominations.  Mr. Kevin Hotard seconded the motion.  Nominations were closed.

 

On a motion by Mr. Thomas Nelson, seconded by Mrs. Debbie Collins, Mr. Joseph Major Thibaut, Sr. was appointed to serve as a member of the Pointe Coupee Parish School Board to represent District F.  Unanimously carried by acclamation.

Discussion/Action to call Special Election(s).  Mr. Cline read the following proclamation:

 

                                                                 PROCLAMATION

 

BE IT RESOLVED by the Pointe Coupee Parish School Board in Special Session, duly convened, that :

 

I.          Acting under and in accordance with the Louisiana Constitution and laws of the State of Louisiana, including La.R.S. 18:602 and La.R.S. 18:402, the Pointe Coupee Parish School Board does hereby resolve and proclaim that:

 

A.         Due to the resignation of Major Thibaut, Jr., Member of School Board District F, the Pointe Coupee Parish School Board does hereby declare that a vacancy exists in the position of Pointe Coupee Parish Member of School Board District F.

 

B.         As Major Thibaut, Jr., was elected to such office for a term of four years and as such remaining term exceeds one (1) year, and, acting pursuant to La. R.S. 18:602 and La.R.S. 18:402, the Pointe Coupee Parish School Board does hereby order a special election to fill the vacancy of Pointe Coupee Parish Member of School Board District F, with the special primary election to be held on April 4, 2009 and the special general election to be held, if necessary, on May 2, 2009.  The qualifying period for such election shall be between February 11, 2009 and February 13, 2009, ending at 5 p.m.  Such elections shall be conducted in accordance with the laws of the State of Louisiana.

 

II.          BE IT FURTHER RESOLVED that, within twenty-four (24) hours hereof, copies of this resolution and proclamation shall be forwarded  by certified or registered mail to the Clerk of the 18th Judicial District Court for Pointe Coupee Parish, the Secretary of State of the State of Louisiana, and the Governor of the State of Louisiana.

 

III.         BE IT FURTHER RESOLVED that the Clerk of Court, Secretary of State, Governor and all other officials having responsibilities with respect to said special election and this resolution and proclamation be requested to perform the duties incumbent upon them.

and the resolution was declared adopted on the 25th day of November, 2008.

Prior to adjournment, Mr. Cline mentioned that according to Dr. Rawls' contract, an annual evaluation of his performance as Superintendent of the Pointe Coupee Parish School Board is conducted.  The evaluation instrument will be provided to all School Board members to complete and return in a sealed envelope.  Members of the Consent Committee (Chad Aguillard, Chairperson, Brandon Bergeron, Kevin Hotard and Major Thibaut) will tabulate the scores that will be reported at the regular School Board meeting on December 18, 2008.  Mr. Cline stated that he would like to request that Mr. "Jody" Major Thibaut, Sr. replace Mr. Major Thibaut, Jr. as a Consent Committee member.  Superintendent Rawls interjected that in addition to the special election to fill the vacancy of Pointe Coupee Parish Member of School Board District F, it would be a prudent and fiscally responsible action of the Board to consider including the renewal of the 11.96 ad valorem taxes to the same ballot.  Dr. Rawls reminded Board members that they were provided a copy of the 2009 elections (revised 6/19/08) at the November 20, 2008 regular meeting.  He stated that he and his staff will need to prepare financial information for a future presentation.  Mr. Brandon Bergeron stated that he would like to schedule a Finance Committee meeting for Tuesday, December 9, 2008.
